Our International Trade Practice advises U.S. and foreign companies on complying with the U.S. laws and regulations that govern the cross-border movement of goods, software, technology and services and otherwise affect the way U.S. companies conduct their overseas business.

We assist clients in evaluating the regulatory implications of transactions as simple as the sale of a single computer and as complex as the acquisition of an overseas corporation. We also assist clients in reviewing the effectiveness of their export compliance efforts and in developing and enhancing compliance programs. We have extensive experience in defending clients suspected of or charged with criminal and civil violations of the export control statutes and regulations.

We also advise clients on compliance with the Foreign Corrupt Practices Act and the anti-boycott regime. The former prohibits U.S. companies from paying bribes to foreign officials in order to obtain or retain business. The latter prohibits such companies from participating in or furthering the objectives of unsanctioned foreign boycotts, most importantly the Arab League boycott of Israel. Both bodies of law frequently require sophisticated analysis to determine whether a given transaction or course of conduct will potentially subject the client to enforcement liability.

In addition, our group advises companies on U.S. Customs and other regulations affecting inbound trade. We help clients address issues such as product classification to determine the applicable duties and design sourcing strategies. As is the case with exports, we have assisted companies under investigation by the U.S. Customs Service for alleged violations of the applicable law. We have also assisted companies subject to investigation by Mexican and Canadian authorities under the North American Free Trade Agreement.
