Cooley Godward Kronish’s Trademark Copyright & Advertising group is devoted to expanding and enforcing our clients’ brands worldwide, and we understand the importance of approaching branding and marketing from a worldwide perspective. Our attorneys and paralegals assist a wide array of companies with legal availability clearances for proposed names, logos and taglines, as well as the prosecution and maintenance of trademark registrations in each of their key business jurisdictions throughout the world. We have strong working relationships with a network of experienced counsel worldwide who work with us on clearance, prosecution, licensing, anti-counterfeiting, copyright and branding dispute matters. In addition, we counsel clients on permissible comparative advertising and unfair advertising issues across a variety of media (including online, radio, television and print), as well as multicultural advertising and marketing concerns related to translation, transliteration, and local consumer perception.

Our team has significant experience handling online branding issues and domain name-related matters, including cybersquatting and domain name acquisitions and assignments. We have successfully represented both complainants and respondents in numerous WIPO domain name dispute arbitrations, obtaining orders to transfer domain names to the rightful brand owners and prohibiting overreaching companies and individuals from taking valuable domain names from our clients. Moreover, we have helped clients pursue cybersquatters via foreign country-code NICs, including Canada (.ca), Italy (.it), Lithuania (.lt), The Netherlands (.nl), the United Kingdom (.uk) and the European Union (.eu, disputes handled through the Arbitration Court of the Czech Republic).

In addition to trademark prosecution and strategic brand counseling, our group has successfully litigated trademark infringement matters over the past three years in a wide range of industries, from the specialty foods, online marketplace and airline industries to the peer-to-peer computer game industry.

We also offer our clients “in-house” training on a variety of cross-border and cross-cultural branding and copyright issues. Recent training seminars organized by our group include High Tech Europe (panelists included attorneys from Cooley as well as others practicing in the UK, Belgium and Germany) and Getting Your Message Out There! (panelists included attorneys from Cooley as well as others practicing in Canada, China, the UK, and Germany).
