Litigation Team Wins Appeal of Criminal Conviction for Former Insurance Executive
New York – July 8, 2010 – Cooley LLP announced that the criminal conviction against Edward McNenney, a former executive at insurance broker Marsh & McLennan Cos., was thrown out last week by New York State Supreme Court Justice James Yates. It was the lone conviction from a 37-count indictment against McNenney stemming from an investigation of anti-competitive sales practices in the insurance industry by the New York Attorney General's office.
It was alleged that McNenney and seven other Marsh executives and brokers took part in a conspiracy to fraudulently obtain millions of dollars for Marsh and its accomplice companies by rigging the market for excess casualty insurance. Following a 10-month long bench trial in 2008, McNenney and fellow Marsh executive William Gilman were acquitted on all counts, except one related to the Donnelly Act. Gilman's conviction was also thrown out.
